Terms of Service

These terms are an agreement between you and Sentivel Ltd (Sentivel, “we”, “us”). They set out the rules for using Sentivel: our website, dashboard, API and the monitoring, status-page and alerting features we provide (together, the “Service”). By creating an account or using the Service, you agree to them.

Agreement to these terms

Sentivel Ltd, a company registered in England and Wales (company registration in progress), with its registered office at 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom, operates Sentivel. These terms, together with our Privacy Policy and, where it applies, our Data Processing Agreement, form the whole agreement between us.

If you use the Service on behalf of an organisation, you confirm you are authorised to accept these terms for that organisation, and “you” means that organisation. You must be at least 18 years old to hold an account.

The service

Sentivel lets you monitor your own services, publish a status page, track third-party providers you depend on, and be alerted when something is wrong. We work hard to make it accurate and reliable, but monitoring is inherently best-effort: we do not guarantee that the Service will detect every incident, alert you in any particular time, or be available without interruption.

We may change, add or remove features over time. If we make a material change that reduces the core functionality you rely on, we will give you reasonable notice where we can.

Your account

You are responsible for your account and for keeping your credentials secure. You are responsible for activity that happens under your account, and for your team members’ use of any workspace you control. Tell us promptly at hello@sentivel.com if you believe your account has been compromised.

Acceptable use

You agree not to:

  • monitor, probe or send checks to systems you do not own or are not authorised to monitor;
  • use the Service to attack, overload or disrupt any system, including ours, or to circumvent its safeguards;
  • use Sentivel’s alerting, email or SMS/voice features to send spam, unsolicited messages, or content that is unlawful, abusive, deceptive or harmful;
  • point a paging destination (such as a phone number) at a premium -rate or otherwise abusive endpoint, or trigger alerts to inflate cost or volume;
  • break the law, infringe anyone’s rights, or upload malware or other harmful content through the Service.

You are responsible for having any consent or authorisation needed to monitor a target and to contact the people you add as responders. We may suspend or limit access if we reasonably believe these rules are being broken, immediately where there is a risk of harm.

Your content

You keep all rights in the content you put into the Service: your component names, incident updates, status-page copy and the like (“Your Content”). You are responsible for Your Content and for making sure you are allowed to publish it.

You grant us a limited, worldwide, royalty-free licence to host, store, process and display Your Content only as needed to operate and provide the Service to you (for example, rendering your public status page). Personal data within the Service is handled under our Privacy Policy and DPA.

Plans, fees and payment

Sentivel is free while it is early, and the features available today are included with no card required. We expect to introduce paid plans later that add scale, for example higher limits and checks from more regions. Paid plans will be clearly described before you choose one, and we will give you notice before anything you rely on starts to cost money.

Where fees do apply in future, they will be stated at the point of purchase, are exclusive of taxes unless stated otherwise, and you are responsible for any taxes due on them.

Third-party services and provider data

Sentivel surfaces the published status of third-party providers you choose to depend on (for example a cloud or payments provider). That information comes from those providers’ own feeds. We are not affiliated with them, we do not control or guarantee the accuracy or timeliness of their data, and their names and marks belong to them and are used only to identify their services.

If you connect third-party tools to Sentivel (such as a chat or calendar integration), your use of those tools is governed by their own terms.

Intellectual property

The Service, including its software, design, and the Sentivel name and marks, belongs to us or our licensors. These terms don’t transfer any of our intellectual property to you; you get a limited right to use the Service as described here.

If you send us feedback or suggestions, we may use them to improve the Service without any obligation to you, and any improvement we build from them is ours.

Availability and changes

We aim to keep the Service available and performing well, but we may carry out maintenance, and outages can happen. We may update the Service, and these terms, as described in “Changes” below.

Disclaimers

The Service is provided “as is” and “as available”. To the extent the law allows, we exclude all implied warranties, including that the Service will be uninterrupted, error-free, or fit for a particular purpose. In particular, Sentivel is a monitoring aid: it does not replace your own operational safeguards, and we do not warrant that it will detect or alert you to every issue.

Limitation of liability

Nothing in these terms limits or excludes our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud.

Subject to that, we are not liable for indirect or consequential loss, or for loss of profits, revenue, data or goodwill; and our total liability arising out of or in connection with the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or £100.

Indemnity

You agree to indemnify us against reasonable losses and costs we incur from your breach of these terms or your misuse of the Service, including monitoring a target you were not authorised to monitor.

Term and termination

These terms apply for as long as you use the Service. You can stop at any time by closing your account. We may suspend or end your access if you breach these terms, or if we reasonably need to, with notice where we can.

Terms that by their nature should survive, such as intellectual property, disclaimers, limitation of liability and governing law, continue after termination.

Changes to these terms

We may update these terms from time to time. When we make a material change we will update the “last updated” date and, where appropriate, let you know. By continuing to use the Service after a change takes effect, you accept the updated terms.

Governing law and disputes

These terms and any dispute arising out of them or the Service are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, unless mandatory law in your country of residence says otherwise.
